1. About Our Service

cooldogname.com provides an AI-powered name generation tool for dog owners. Users may:

• Generate dog names based on breed, personality, and other preferences
• Upload images of dogs for better personalization
• Like or dislike suggested names
• Save or delete generated names
• Create temporary or registered accounts to manage name lists

The service is intended for entertainment and personalization purposes only.

2. Age Restriction

You must be at least 13 years of age to use this service. By using the Service, you represent and warrant that you are at least 13 years old. If we discover or have reason to believe that a user is under 13, we reserve the right to terminate their account and delete any associated data.

3. Our Role and AI-Generated Content

Our Service functions as an intermediary interface to third-party artificial intelligence (AI) models. We do not create, own, or control the underlying AI models or the data they generate ("Generated Content"). We do not monitor, see, or control the interactions between a user's input and the AI model's output.

Consequently, we disclaim all responsibility and liability for the Generated Content. Due to the nature of AI, ownership of Generated Content may be ambiguous and not subject to copyright protection. We do not claim any ownership rights over it. Any conflict or issue arising from the Generated Content, including but not limited to its legality, accuracy, or infringement of third-party rights, is a matter strictly between the user and the AI-generated output. You agree that we are not a party to, and will not be held liable for, any such dispute.

You are solely responsible for your use of any Generated Content and must independently verify its suitability and legality for your intended purpose.

4. Account Types and Data

a) Temporary Users

• Temporary users are created when using the service without signing in.
• Temporary user data is stored locally and server-side.
• If email registration is not completed within 48 hours, the account and all data (names, photos) will be automatically deleted by our system.

b) Registered Users

• Registered users have access to persistent storage of names and preferences.
• Users can request deletion of their account and all associated data at any time.

c) Service Limitations

We reserve the right to apply certain restrictions to unauthenticated (temporary) users to ensure system stability and fair access. These restrictions may include, but are not limited to, limits on the number of name generations or features available.

Furthermore, all users acknowledge that the Service may be subject to technical limitations, such as rate limits on requests or other operational constraints necessary to ensure the performance and fair use of our platform. These limitations may apply to both temporary and registered users and can be changed at our discretion.

5. User-Generated Content

5.1. User Responsibility and Representations

You are solely and exclusively responsible for any text, data, images, or other materials ("User Content") that you enter, upload, or otherwise provide through our Service. By providing User Content, you represent and warrant that:

• You own all necessary rights to the User Content or have permission to use it.
• Your User Content does not infringe upon the rights of any third party, including copyright, trademark, or privacy rights.
• Your User Content does not violate any applicable laws, regulations, or the terms of service of any underlying AI models used by the Service.

5.2. No Monitoring and Disclaimer of Liability

You acknowledge that the Service does not monitor, review, or control User Content. We expressly disclaim any and all liability in connection with User Content. Any use of or reliance on our Service's analysis of your User Content is at your own risk.

5.3. License Grant to Us

By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to process it solely for the purpose of generating personalized name suggestions and providing the Service to you.

5.4. Use of Images for AI Training

We will never share your images publicly or sell them. You agree that if you do not delete your profile, your non-personally identifiable image data might be used in an aggregated and anonymized form to train our AI models. This applies only to images and not to other forms of data you provide.

5.5. Deletion of Content

You can delete your User Content at any time where the interface permits. All your User Content will be permanently deleted if you delete your profile. Temporary user data is automatically deleted after 48 hours as described in Section 4.

6. Privacy and Data Use

7. California Residents' Rights

8. Intellectual Property

All branding, design, website code, and other assets related to the Service itself are the exclusive property of cooldogname.com.

As stated in Section 3, we do not claim ownership of the names or other content generated by the AI for you.

You may not copy, redistribute, or reverse engineer any part of our platform or Service without our express written permission.

9. Restrictions and Prohibited Use

You agree not to:

• Misuse the Service (e.g., spam, bots, reverse engineering).
• Use the Service or any content obtained from it for illegal, harmful, or fraudulent purposes.
• Upload or enter content that is offensive, harmful, or violates the rights of others.

Accounts violating these rules may be suspended or deleted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COOLDOGNAME.COM WILL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, YOUR USER CONTENT, OR ANY AI-GENERATED CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF COOLDOGNAME.COM EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

11. Indemnification

You agree to defend and indemnify cooldogname.com from any claims or damages arising from your User Content, your use of AI-Generated Content, or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your account at our discretion.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes implies acceptance.

14. Governing Law

These Terms are governed by the laws of the state of North Carolina, United States.
